Privacy Policy

This Privacy Policy explains how personal data is handled when you use the Winter OPS application (“Winter OPS”, the “App”).

Privacy at a glance

  • Winter OPS does not require a user account.
  • Avimont GmbH does not collect or maintain user profiles, names, email addresses, contacts, precise location data, or advertising profiles through the App.
  • We do not use the App for advertising or cross-app tracking.
  • Purchases and subscriptions are handled through Apple App Store and/or Google Play, with RevenueCat used to manage purchase and subscription entitlements.
  • RevenueCat therefore processes limited technical and transaction information required to provide this functionality.

2. Data processed when you use Winter OPS

Winter OPS is designed to minimize the processing of personal data. The App does not require registration or a user account, and Avimont GmbH does not operate a user-profile database for the App.

We do not intentionally collect or store through Winter OPS:

  • your name, postal address, email address, or phone number;
  • contacts or address-book information;
  • precise or coarse location information;
  • photos, videos, audio recordings, health information, or other sensitive personal data;
  • advertising profiles or data for cross-app tracking; or
  • analytics or crash-reporting data through a separate analytics/crash-reporting service.

The exception is the limited data processing necessary for in-app purchases and subscriptions, as described below.

3. Purchases and subscriptions

If you make or restore an in-app purchase or subscription, the transaction is processed by the platform through which you obtained the App, such as Apple App Store or Google Play. Avimont GmbH does not receive or store your full payment-card details.

RevenueCat

We use RevenueCat, Inc. to determine whether a purchase or subscription is valid and which App features you are entitled to use.

In connection with this function, RevenueCat may process limited end-user information such as:

  • an App User ID used to associate purchase entitlements with an installation or user;
  • purchase and subscription history;
  • Apple receipt information or Google purchase tokens;
  • the time the App was last seen by RevenueCat; and
  • basic technical information such as device type and operating system.

Winter OPS uses RevenueCat for purchase/subscription functionality, not for advertising. Unless explicitly added in a future version of the App, we do not provide RevenueCat with your name or email address and do not use a custom personally identifying account ID.

Apple and Google

Apple and Google process purchase, billing, account, device, and related information under their own terms and privacy policies. Their processing is separate from the limited processing carried out by Avimont GmbH for Winter OPS.

5. Service providers and recipients

We do not sell personal data. Personal data connected with purchases or subscriptions may be processed by:

  • RevenueCat, Inc., as our service provider/data processor for purchase and subscription entitlement management;
  • Apple, if you obtain the App or make purchases through the Apple App Store; and
  • Google, if you obtain the App or make purchases through Google Play.

These providers may use subprocessors or infrastructure providers as described in their own privacy documentation and contractual terms.

6. International data transfers

RevenueCat, Inc. is based in the United States and may process data in the United States or other countries in which it or its subprocessors operate. Where a transfer from Switzerland, the EEA, or another jurisdiction requires safeguards, appropriate contractual or statutory transfer mechanisms are used.

RevenueCat’s Data Processing Addendum provides for the EU Standard Contractual Clauses and adaptations for transfers subject to Swiss data-protection law. Additional details are available in RevenueCat’s Data Processing Addendum.

7. Data retention

Avimont GmbH does not maintain a separate user-profile database for Winter OPS. Purchase/subscription information processed through RevenueCat is retained in accordance with the RevenueCat service agreement, its Data Processing Addendum, applicable legal requirements, and any valid deletion request.

RevenueCat’s current Data Processing Addendum states that customer personal data is retained until termination or expiry of the applicable agreement, subject to the deletion/return provisions of that agreement. We may also need to preserve limited transaction-related information where required by law or necessary for the establishment, exercise, or defence of legal claims.

8. Security

We use reasonable technical and organizational measures appropriate to the nature and limited scope of the data processing described above. We also select service providers that offer contractual and technical safeguards for the information they process on our behalf.

No electronic transmission or storage system can be guaranteed to be completely secure. If we become aware of a personal-data breach, we will handle it in accordance with applicable notification and remediation requirements.

9. Your privacy rights

Depending on where you live and which law applies, you may have rights concerning personal data relating to you. These may include the right to:

  • request information about whether and how your personal data is processed;
  • obtain access to personal data concerning you;
  • request correction of inaccurate data;
  • request deletion of data where the legal requirements are met;
  • request restriction of processing or object to certain processing where applicable; and
  • receive or transfer certain data in a portable format where applicable.

Because Winter OPS does not require an account and RevenueCat may identify an installation using an anonymous App User ID, we may need information from your device or purchase to locate the relevant RevenueCat record before we can act on a request.

To exercise a privacy right, contact Avimont GmbH using the details in Section 13. You may also have the right to contact or lodge a complaint with the competent data-protection authority, including the Swiss Federal Data Protection and Information Commissioner (FDPIC) where Swiss law applies.

10. Children

Winter OPS is not specifically directed at children and we do not knowingly request personal information from children through the App. Purchase functionality is subject to the account, parental-control, age, and purchase rules of the applicable app-store platform.

If you believe that personal data relating to a child has been processed through Winter OPS inappropriately, please contact us so that we can review the matter.

12. Changes to this Privacy Policy

We may update this Privacy Policy when the App, our service providers, or legal requirements change. The current version will be made available through the App, the App’s store listing, our website, or another appropriate location. The “Last updated” date at the top of this page indicates when this Policy was most recently revised.

If a change materially affects how personal data is processed, we will provide additional notice where required by applicable law.
